Law on amnesty for participants in the January events was signed by President

The head of state signed the Law of the Republic of Kazakhstan "On Amnesty",

The text of the Law is published in the press.

The law is aimed at releasing from serving a sentence persons who fell under the influence of provocateurs and committed criminal acts in the conditions of riots in the period from January 4 to January 7, 2022.

Also under the amnesty will fall law enforcement officers and the military, who committed criminal offenses in the suppression of illegal acts of citizens during the January events.

Criminal cases against participants in the riots who have committed criminal offenses, crimes of small and medium gravity will be stopped, those convicted of them will be released from punishment, and those who have served will have their convictions removed. Persons who have committed grave crimes will have their sentences imposed by the courts reduced by three quarters, especially grave crimes by half.

At the same time, if the convict has no more than one year left to serve the sentence on the day the law enters into force, the main sentence is reduced by the entire unserved term.

Persons who have committed terrorist, extremist, corruption crimes, high treason, organization of mass riots (except for the case when this crime is committed by a minor), torture, crimes against the sexual integrity of minors are not subject to amnesty.

According to preliminary calculations, about 1.5 thousand people fall under the amnesty. To date, out of 1,112 convicted in the January events, only 128 people are deprived of their liberty.

In relation to 363 persons who have committed grave crimes in cases that are under investigation and pending in the courts, the amnesty will be applied when sentencing.

Along with this, in order to ensure social adaptation and resocialization of released persons, the Government and local executive bodies have been assigned the relevant duties, namely: to ensure employment of able-bodied persons released from institutions; to provide them with social and other assistance in accordance with the legislation of the Republic of Kazakhstan; on the placement of those who do not have a fixed place of residence, released from punishment under an amnesty in centers for the resocialization of persons who find themselves in a difficult life situation.
