Kazakh Senate amends draft law on peaceful assemblies

At a plenary session the Senate of the Parliament returned the draft law on peaceful assemblies with the accompanying amendments, changes and additions to the Majilis. The draft laws, according to the regulations, are returned to the Majilis with amendments of the Senate.

As noted in the conclusion to the documents, the Senate proposes to establish that in the central parts of the districts in cities of republican significance, the capital, as well as in the administrative centers of the regions, the number of specialized places for organizing and holding meetings or rallies should be at least three.

At the same time, it is proposed to exclude the obligation of the organizer of peaceful assemblies, at the request of participants in peaceful assemblies, not to hide their face, including not to use clothing and (or) other means that impede face recognition, since issues of ensuring public order are within the competence of law enforcement bodies.

At the same time, it is proposed to consolidate the right of the organizers and participants of a peaceful assembly to use personal protective equipment aimed at protecting health.

"It is proposed, in view of the broad interpretation, to exclude the reason for refusing to hold peaceful assemblies if holding peaceful assemblies may lead to disruption of the functioning of life support facilities, transport or social infrastructure, communications, create obstacles for the uninterrupted functioning of transport, infrastructure, entail violation of the conservation of green spaces, small architectural forms and other property, as well as impede the free movement of citizens who are not participating in peaceful assemblies," the conclusion reads.

The grounds for termination of a peaceful assembly are excluded, among which the performance of violent acts by participants in a peaceful assembly, as well as a violation by the organizer of a peaceful assembly of the requirements of the draft law regarding the organization and conduct of peaceful assemblies.

In addition, a norm is proposed which provides that a violation by a participant or individual participants in peaceful assemblies of the requirements of the bill entails the termination of their participation in peaceful assemblies. In this case, if the violation is eliminated, the peaceful assembly will continue.
