Kazakh President signs legislation on healthcare

The President signed the Code of the Republic of Kazakhstan on people’s health and healthcare. As noted by Senator Serik Bekturganov, it is proposed to leave in the Penal Code the violation by medical personnel of the procedure for clinical trials, the use of new methods of prevention remedies, diagnosis, treatment and medical rehabilitation only if it entailed serious consequences, or was committed by an official.

“At the same time, it is proposed to transfer the same acts to the Code of Administrative Infractions if they did not entail serious consequences and were not committed by an official,” the senator explained.

Also, according to the amendments introduced by the Senate, in order to initiate a criminal case for medical offenses, the application has to be supplemented by the relevant acts of inspections and audits conducted by the authorized state body.

“Now any application for the actions of doctors immediately brings a criminal case, which necessarily entails the conduct of various examinations, interrogations of suspects and interviews of witnesses, seizure of materials and other investigative measures. This not only overloads the investigative apparatus, but also paralyzes the work of doctors, creates an atmosphere of suspicion and mistrust around them. At the same time, of all the cases instituted on the basis of only one statement, a very small part reaches the court, "the senator explained.
